1. Agreement
These Terms govern access to and use of A-Que Cloud. By creating an account or purchasing a subscription, the customer agrees to these Terms and the documents incorporated into them.
2. A-Que services
A-Que provides cloud-based accounting, membership and events, Classroom and Financial Insights functionality. Product descriptions may be updated as the service develops, provided material paid functionality is not removed without reasonable notice.
3. Accounts and authorised users
The customer is responsible for accurate registration information, authorised users, secure credentials and activity performed through its accounts. Administrators must remove access when a user is no longer authorised.
4. Subscription, payment and renewal
The applicable price, currency, billing period and renewal arrangement will be shown before purchase. Payments are processed through the nominated payment provider. The customer authorises recurring charges where an automatically renewing subscription is selected.
5. Cancellation and money-back guarantee
The customer may cancel future renewal through the Subscription Centre. The one-month money-back guarantee applies according to the published Guarantee terms. After that period, change-of-mind refunds are not provided, except where required by law.
6. Customer data
The customer retains ownership of data entered into A-Que and is responsible for having authority to collect and use that data. A-Que may process customer data only to provide, secure, support and improve the service, as described in the Privacy Policy.
7. Acceptable use
A-Que must not be used unlawfully, to infringe another person's rights, to introduce malicious code, to attempt unauthorised access, to disrupt the service or to store information the customer has no authority to hold.
8. Intellectual property
A-Que and its original software, design, content and branding remain the property of the provider or its licensors. A subscription gives the customer a limited, non-transferable right to use the service during the subscription period.
9. Availability, support and changes
A-Que will take reasonable steps to keep the service available and secure. Temporary interruptions may occur for maintenance, security, internet, hosting or other operational reasons. Support arrangements will be described on the website or within the application.
10. Financial information and professional advice
A-Que assists with record keeping, calculations, education and reporting. It does not provide personalised accounting, taxation, legal, investment or financial advice. Customers remain responsible for decisions and for obtaining professional advice where appropriate.
11. Liability and consumer rights
Nothing in these Terms excludes rights or remedies that cannot lawfully be excluded. Any permitted limitations of liability must be settled with legal counsel and written clearly and fairly.
12. Ending access and data export
The Terms should specify access after cancellation, available export methods, the period for retrieving data and the process and timing for deletion or de-identification. These operational periods must be confirmed before publication.
13. Governing law and disputes
The governing law, jurisdiction and practical complaint or dispute process must be inserted following Australian legal advice, taking account of international customers and mandatory local consumer rights.
